The EPA is being sued by The National Petrochemical and Refiners Association (NPRA) to delay restrictions placed on them to protect the ozone layer. The EPA is requiring companies to submit plans in 2007 on how they will comply with new standards to reduce smog by 2009. The new rules allow less ozone -- 85 parts per billion down from 120 parts per billion -- and require more frequent tests.
"We have a comprehensive solution ... and are committed to doing what we can to help states come into attainment and meet their deadlines," an EPA spokeswoman said.
NPRA President Bob Slaughter said that the proposed standards would limit production capabilities and that many refining centers "cannot possibly achieve attainment in the time period required by their designation."
