As a result of several court decisions, coal operators have been informed that some of the material they discharged into streams is illegal. EPA, in a very
prudent move, has stated that if coal operators confess to their sins and remedy their actions, that they not be subject to fines. Actions such as this should be applaued. It is very easy for pundits to criticize officials; its time that postiive actions be applauded.
"Eligible operators will be offered a one-time opportunity to voluntarily participate in this program, report on their violations, perform any necessary mitigation, and pay reduced penalties that are well below those EPA would normally seek,” says a one-page Aug. 13 paper describing the program."
