In a potentially precedent setting case, a District Court judge in Maine has ruled that escaping fish are now pollutants.
More specifically, a fish farm was introducing non-native salmon into rivers which allegedly were destroying native salmon. The judge ruled that the discharge of non-native species is covered by the Clean Water Act. This decision could have impacts where non-native fish are being introduced to destroy native plants when such plants are in excess and deplete oxygen levels in the water.
