Oceana Says it Will Sue NMFS over Cuts in Observer Funding
The international environmental NGO Oceana sent Commerce/NOAA/NMFS a letter stating that Oceana will sue the agencies over funding cuts to the agencies' Northeast observer program. This program pays observers to ride commercial fishing vessels and monitor bycatch of sea turtles, and of whales and other marine mammals. The Oceana letter states that the lawsuit will be brought under the Endangered Species Act. Under the ESA, the agencies have sixty days from their receipt of the Oceana letter to correct the statutory violations alleged in the letter. If they do correct them, then Oceana cannot file suit. Oceana has twice before sued the agencies over the observer program. Oceana won both prior cases.
