Amended by Public Law 102-486, Title XXIV, 2406, October 24, 1992, 106 Stat. 3099, Public Law 103-437, 6(u), November 2, 1994, 108 Stat. 4587 and Public Law 104-206, title V, 512, September 30, 1996, 110 Stat. 3005.
This 1980 statute authorized the establishment and operation of the Pacific Northwest Electric Power and Conservation Planning Council, and provided that two persons from the states of Idaho, Montana, Oregon, and Washington be appointed to the Council.
Among other things, the Council is responsible for preparing a regional conservation and electric power plan as well as a fish and wildlife protection, mitigation, and enhancement program to deal with the operation of hydroelectric facilities on the Columbia River and its tributaries. The statute defines the priorities to be addressed and the procedures to be followed for both the electric power plan and the fish and wildlife program.
Amendments enacted in 1984 (P.L.98-381) authorized the Secretary of Interior to design, construct, operate and maintain fish passage facilities within the Yakima River Basin in accordance with this statute.
Public Law 102-486, Title XXIV, 2406, October 24, 1992, 106 Stat. 3099 requires the Secretaries of Army and of the Interior to develop plans for operating federal projects in the Pacific Northwest.
Public Law 103-437, 6(u), November 2, 1994, 108 Stat. 4587 makes a minor name change.
Public Law 104-206, Title V, 512, September 30, 1996, 110 Stat. 3005 calls upon the North West Power Planning Council to appoint an independent scientific review panel to review projects funded through the Bonneville Power Administration's annual fish and wildlife budget that implements the Council's fish and wildlife program. The Council shall establish Scientific Peer Review Groups to advise the Council about funding decisions for fish and wildlife projects. Authorization for Appropriations is set at $2 million per year and the authority expires in fiscal year 2000.
