CRE Analysis
2. Do existing exemptions under the Freedom of Information Act (FOIA) still apply, and are they adequate to protect the data in question?
Background:
The FOIA statute contains a list of exemptions for agencies to apply when considering public requests for data. Examples of such exemptions include protections for medical and personnel information, trade secrets and confidential business information, and information affecting national security. These exemptions have proven flexible in the past to protect against improper disclosure of information, and CRE believes that they can be extended to grantee-generated data under Circular A-110.
