Park Service Intends to Publish New Rules for Oil and Gas Development in National Parks
On November 25, 2009, the U.S. National Park Service published in the Federal Register Advance Notice of Proposed Rulemaking on regulating oil and gas development in the federal National Park System. The Park Service explains in its ANPR that
"We are seeking comments to assist us in developing proposed a
proposed rule to revise regulations governing nonfederal oil and gas
development within the boundaries of units of the National Park System.
The regulations have been in effect for over thirty years and have not
been substantively updated during that period. The National Park
Service (NPS) is seeking public input on how to bring exempted
operations under the scope of the regulations, and on how to improve
resource protection aspects of the regulations while accounting for
advances in oil and gas technology and industry practices."
The Park Service specifically asks for public comment on
-
Regulation of currently exempt operations;
-
Directional drilling;
-
Operating standards;
-
Financial assurance;
-
Access fees; and
-
Assessments for non-compliance.
Public comments must be received by the Park Service by January25, 2010.
