NMFS Issues GOM IHA to ExxonMobil
On July 3, 2012, the U. S. National Marine Fisheries Service published Federal Register notice that it has issued a one-year Letter of Authorization to ExxonMobil to take marine mammals incidental to the explosive removal of offshore oil and gas structures in the Gulf of Mexico. This LOA is effective from July 1, 2012 through June 30, 2013. It is issued under the Marine Mammal Protection Act and under NMFS' implementing regulations. NMFS published Regulations governing the taking of marine mammals incidental to explosive removals in the GOM on June 19, 2008 (73 FR 34875). These implementing regulations remain in effect through July 19, 2013. Issuance of the LOA to ExxonMobil is based on a finding made in the preamble to the implementing regulations that the total taking over the five-year period (with monitoring, mitigation, and reporting measures) will have a negligible impact on the affected species or stock(s) of marine mammals and will not have an immitigable adverse impact on subsistence uses.
