On May 5, the US Food and Drug Administration (FDA) released its long-awaited regulations on electronic cigarettes and vaping products. These rules, which require every one of the more than 10,000 vaping products on the market to submit a pre–market approval application simply to stay on the market, were widely applauded by antismoking and health groups. What may not have been apparent at the time, but what I have discovered through a detailed analysis of the 499-page regulations, is that these regulations not only fail to protect the public’s health, but they impose a public safety hazard.

Ron Johnson pursues radio talker’s vaping cause

In recent months, U.S. Sen. Ron Johnson has taken up the vaping cause, trying to stub out efforts by the U.S. Food and Drug Administration to regulate e-cigarettes.

Over the past month, Johnson sent two letters to Food and Drug Administration Commissioner Robert M. Califf, asking him to justify the agency’s plans to begin regulating the $3 billion vapor market beginning later this summer.

They say regulation is always a step behind the money. Approximately 10 years after the commercialization of e-cigarettes, the U.S. Food and Drug Administration (FDA) announced new regulations on the $3.5 billion industry.

The centerpiece of the regulations is to regulate the e-cigarettes, vaporizers, e-pipes and other electronic nicotine delivery systems similar to the way cigarettes are regulated. Mainly, FDA approval shall soon be required to sell, manufacture, import or distribute e-cigs. E-cig manufacturers will have until 2018 to sell their products while they submit to FDA approval. Manufacturers will have one additional year to continue to sell while the FDA reviews their application to ensure that the e-cigs meet the FDA’s requirements to sell to the public.

In response to the regulations, she said a coalition has formed between consumer vaping and industry associations—a total of seven—and that together they are looking into what kind of litigation they might pursue. At her shop, Cherry Vape, Richter is focusing on effecting change by educating her clients.

“I think that in 20 years from now when the books are written about this, this is going to be the pivotal time in history, right now: you know, what did we do, what did we do when the government said, no, you have to keep smoking,” Richter said.
