An e-cigarette industry association this week claimed to be in possession of the U.S. Food and Drug Administration’s forthcoming deeming regulations, but the provenance and authenticity of the brief excerpts that it published remain unclear.

What This Means: While TVECA has clearly obtained documents of some kind, there is far too much uncertainty to make a confident reading on the final shape of the deeming regulations – let alone for businesses (except perhaps those selling premium cigars) to take any action based on them.

FTC Plans to Study E-Cigarette Sales & Marketing

WASHINGTON, D.C. — Another federal agency will put electronic cigarettes under its regulatory microscope.

The Federal Trade Commission (FTC) said on Monday it plans to study the sales and marketing of e-cigarettes in the United States. To conduct the study, the agency would issue information requests to e-cigarette marketers and would use the information as a basis for a report on the sales, marketing activities and expenditures in this new and complex industry.

Walking down most British high streets you could be forgiven for thinking that e-cigarettes are more common than tobacco. It’s a false impression. There are still more smokers than vapers, but more than anywhere else in the world, you see men and women clutching a variety of shiny vaping devices. I suspect only a handful of them are aware that their e-cigarettes will be snatched from them in a few months time as a result of EU regulations that are — even by the standards of Brussels — misguided, ill-considered and counter-productive.

DEEMING RULE

The big question in the room, of course, was when the agency will issue its final deeming rule, giving it authority over electronic cigarettes, cigars, pipe tobacco and certain dissolvable products that are not smokeless tobacco.

“There is a reason we don’t talk publicly about things that have not been decided yet,” Zeller said Sunday. “The process is deliberative and we cannot talk publicly about non-decisions.”
