JERSEY CITY, N.J. — As a category at retail, other tobacco products (OTP) continues to change at rapid speed, presenting convenience store operators with tough decisions. However, with all the talk about evolution and innovation, the top three OTP segments still rule: smokeless tobacco, cigars and electronic cigarettes.

While he acknowledged there is a lot of conversation about the Food and Drug Administration (FDA) and what form its final deeming regulation will take, he advised all trade partners — retailers, manufacturers and wholesalers — to take notice of what is happening at the local and state levels. Legislation aimed at age restrictions and taxation issues dominate the talk at those levels.

New bills could impose strict rules on manufacture and sale of electronic nicotine delivery devices

Mike Cline, 64, started selling electronic cigarettes almost by accident. A lifelong smoker, he took the advice of his son and on Nov. 7, 2009, tried a popular alternative to smoking cigarettes. He inhaled from an e-cigarette.
“I haven’t wanted a cigarette since then. This has been a miracle,” Cline said.

The acting head of the Food and Drug Administration (FDA) said Monday that the agency is moving “full speed ahead” with its efforts to crack down on the use of e-cigarettes.
Two weeks into his tenure, Dr. Stephen Ostroff said strengthening tobacco regulations is one of his top priorities. He pointed to alarming new federal data that showed the use of e-cigarettes among middle and high school students has tripled in the last year — a trend that landed on the front page of nearly every national newspaper.

Clues From Zeller’s Session
Mitch Zeller last appeared at the NATO Show very shortly after taking over the CTP in 2013. While there were plenty of “no comments” during that general session, Zeller did provide a glimpse into his top priorities: menthol, deeming and substantial equivalence (SE). Within one year, the FDA requested public comments on menthol, issued its first-ever SE approvals and announced proposed deeming regulations on cigars, electronic cigarettes and other previously un-deemed tobacco products.
