The Future of Regulatory Oversight and Analysis

 “ OIRA  currently operates under President Clinton’s 1993 Executive Order (EO) 12866, which requires centralized, coordinated review of regulations, and states that agencies should “adopt a regulation only upon a reasoned determination that the benefits of the intended regulation justify its costs.”

OIRA’s Formative Years: The Historical Record of Centralized Regulatory Review Preceding OIRA’s Founding

“However, there seemed to be a consensus that substantive centralized regulatory review of regulations began under President Reagan. This consensus mistakenly discounts the fifteen years proceeding OIRA during which centralized review was developed and implemented by OMB and vetted in the agencies and by Congress and the judiciary. Although OIRA was created under President Carter and began operations under President Reagan, its beginnings should rightfully be traced back to President Johnson’s Administration.”
