EPA Requests Comment on NOX Settlement
EPA has proposed a settlement of industry challenges to the Agency's Clean Air Act standards of performance for Stationary Gas Turbines. The settlement, if adopted by EPA and approved by the court, would settle judicial challenges filed by the Interstate National Gas Association of America.

The settlement commits EPA either to propose rules, or to promulgate "direct final rules," that "clarify our intent that nothing in [the original rules] was meant to impose new requirements for turbines constructed after 1977... that do not use water or steam injection to control NOX emissions."

Public comment on the proposed settlement must be received by EPA by September 14, 2005.
